National Conventional Arms Control Committee (NCACC)

Background Information
Legislation:

  • The National Conventional Arms Control Act, No 41 of 2002 as amended, and it’s supporting Notices and Regulations.
  • The Regulation of Foreign Military Assistance Act, No 15 of 1998.
  • Anti-Personnel Mines Prohibition Act, No 36 of 2003.

The authority responsible for the control over trade in conventional arms and rendering of foreign military assistance is the National Conventional Arms Control Committee (NCACC).

  • The NCACC is a statutory body that reports to Parliament and consists of Cabinet Ministers and Deputy Ministers.
  • No person may trade in conventional arms or render foreign military assistance unless that person is registered with the Chief Directorate Conventional Arms Control (CDCAC) and is in possession of a permit authorised by the Committee and issued by the DCAC. Permits are required for armaments development and manufacturing, marketing, contracting, exporting, importing or transferring (conveyance) of conventional arms, which includes; weapons, munitions, vessels (land, sea and air) designed for war, articles of war, and related systems, components, technologies, dual-use goods or services. .
  • Applications for registration and permits are processed by the CDCAC, which refers them to various departments for review. These reviews are considered by the Scrutiny Committee, which makes recommendations to the NCACC.

Nuclear Materials and Related Technology

Background Information

The Minister of Energy and its control structures, are responsible for the control over the export of source and special fissionable materials, as well as equipment or material especially designed or prepared for the processing, use or production of special fissionable material (NSG Part 1).

The role of the Department in terms of the Nuclear sector is to administer all nuclear matters as required by legislation and international agreements

Control of Firearms, Ammunition and Related Material

Background Information

The authority responsible for the control over firearms, ammunition and related material is the Department of Police.

No person may acquire or possess a firearm, ammunition or related material unless that person is in possession of a license, permit or authorisation issued by the South African Police Service.

No person may manufacture or trade in firearms and/or ammunition or conduct business as a gunsmith unless in possession of a licence issued by the South African Police Service.

Applications for firearm licences, permits or authorisations must be submitted to the relevant Designated Firearms Officer at the local Police Station.

Applications for export of firearms and ammunition, controlled in terms of the Firearms Control Act, No 60 of 2000, must be submitted to the NCACC for approval.

Control of Explosives

Background Information

The Chief Inspector of Explosives, is appointed by the Minister of Police and is responsible for the control over explosives. Some of the Chief Inspector’s functions include:

  • The authorisation and classification of all explosives manufactured in and imported into South Africa
  • The issuing of explosives import, export, transit, transport and user permits to registered persons and entities
  • The licensing of explosives vehicles and explosives magazines
  • Ensuring that all plastic explosives manufactured or imported are marked for the purposes of detection

Applications for registration, licences and permits must be submitted to the Chief Inspector’s Office in Pretoria.

Note: The issuing of import, export and transit permits for military explosives, explosive ordinance and tear-gas, is subject to permits issued by the NCACC and NPC.
